Uncertn Apple AirPods 4 Giveaway – Official Sweepstakes Terms

SECTION 1 – SWEEPSTAKES PERIOD

The 'Uncertn Apple AirPods (4th Generation) Giveaway' (the “Sweepstakes”) begins at 12:00:01 a.m. Eastern Standard Time (“EST”) on the first day of each calendar month and ends at 11:59:59 p.m. EST on the last day of that same calendar month (the “Promotion Period”).

Each Promotion Period constitutes a separate sweepstakes. Entries do not carry over into subsequent Promotion Periods. The Sponsor’s computer system shall be the official time-keeping device for the Sweepstakes.

SECTION 2 – SPONSOR AND ADMINISTRATOR

The Sweepstakes is operated by Uncertn Inc., an Ontario corporation (the “Sponsor”).

This Sweepstakes is not sponsored, endorsed, administered by, or associated with Apple Inc. or any social media platform.

SECTION 3 – ELIGIBILITY

The Sweepstakes is open only to legal residents of Canada and the United States who are of the age of majority in their province, state, or territory of residence at the time of entry.

Residents of the Province of Québec, the States of New York, Florida, and Rhode Island, and any other jurisdiction where the Sweepstakes is prohibited or restricted by law are not eligible to participate.

Employees, officers, directors, agents, contractors, and representatives of the Sponsor, its affiliates, subsidiaries, advertising or promotion agencies, and their immediate family members or household members are not eligible.

The Sweepstakes is void where prohibited or restricted by law.

SECTION 4 – HOW TO ENTER / NO PURCHASE NECESSARY

No purchase necessary to enter or win. A purchase will not increase the chances of winning.

Eligible participants may enter by one (1) of the following methods.

Online Entry:
Complete the official online entry form and submit all required information as instructed.

Mail-In Entry:
On a 3" x 5" card, hand-print the following: “Uncertn Apple AirPods Giveaway,” full legal name, complete mailing address, city, province/state, postal or ZIP code, email address, and date of birth.

Mail-in entries must be postmarked and received by the final day of the applicable Promotion Period.

Limit one (1) entry per person, per Promotion Period, per email address, and per household, regardless of method of entry. Entries generated by script, macro, bot, or other automated means are void.

SECTION 5 – PRIZE

One (1) prize will be awarded per Promotion Period.

The prize consists of one (1) pair of Apple AirPods (4th Generation) with an approximate retail value (“ARV”) of CAD $179.

No cash alternative, substitution, or transfer of the prize is permitted, except at the sole discretion of the Sponsor.

SECTION 6 – ODDS

The odds of winning depend upon the total number of eligible entries received during the applicable Promotion Period.

SECTION 7 – WINNER SELECTION

One (1) potential winner will be selected in a random drawing from all eligible entries received during the Promotion Period.

The drawing will be conducted within seven (7) days following the end of the Promotion Period by the Sponsor or its designated representative, whose decisions are final and binding.

SECTION 8 – SKILL-TESTING QUESTION

As required by applicable Canadian law, Canadian residents must correctly answer a time-limited mathematical skill-testing question, without assistance, before being declared a winner.

Failure to correctly answer the skill-testing question will result in disqualification.

SECTION 9 – WINNER NOTIFICATION

The selected entrant will be notified using the contact information provided at entry.

If the selected entrant fails to respond within seventy-two (72) hours, is determined to be ineligible, fails to execute required documentation, or fails to correctly answer the skill-testing question (if applicable), the prize may be forfeited and an alternate winner selected.

SECTION 10 – GENERAL CONDITIONS

The Sponsor reserves the right, in its sole discretion, to cancel, suspend, modify, or terminate the Sweepstakes if fraud, technical failures, human error, unauthorized intervention, or any other cause beyond the Sponsor’s control impairs the integrity or proper functioning of the Sweepstakes.

All decisions of the Sponsor are final and binding.

SECTION 11 – RELEASE AND LIMITATION OF LIABILITY

By participating, entrants agree to release and hold harmless Uncertn Inc., its affiliates, subsidiaries, officers, directors, employees, agents, and representatives from any and all liability arising from participation in the Sweepstakes or acceptance, possession, use, or misuse of the prize.

The prize is awarded “as is” without warranty of any kind, express or implied.

SECTION 12 – PRIVACY

Information collected in connection with the Sweepstakes will be used solely for the administration of the Sweepstakes and in accordance with the Sponsor’s Privacy Policy and applicable privacy laws.

SECTION 13 – GOVERNING LAW AND VENUE

The Sweepstakes shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

All disputes shall be resolved exclusively in the courts located in Ontario, Canada, and entrants consent to such jurisdiction and venue.

SECTION 14 – WINNER LIST

Requests must be received within thirty (30) days following the applicable drawing date.

SECTION 15 – SPONSOR’S RIGHT TO MODIFY

The Sponsor reserves the right to modify, suspend, or terminate the Sweepstakes or these Official Rules at any time, with or without notice, in its sole discretion.
